§1 Scope, subject matter and conclusion of the respective contract
The following terms and conditions conclusively govern the contractual relationship between FDC Events, a business unit of financial.com AG represented by the members of the Executive Board Dr Alexis Eisenhofer, Dr Yann Samson and Dr Steffen Böhnert, Georg-Muche-Str. 3, 80807 Munich, hereinafter referred to as the ‘Organiser’, and the respective customer. These General Terms and Conditions apply exclusively. Any terms and conditions of the customer that conflict with or deviate from these terms and conditions will not be recognised unless the Organiser has expressly agreed to them in individual cases. The subject matter of the respective contract is the sale of tickets by the Organiser to the customer for the event currently offered by FDC Events. The customer can purchase tickets for the respective event via the organiser’s website. Upon completion of the ticket ordering process, a valid contract is concluded between the parties. The contract is concluded in German or English. German law applies.
§2 Settlement of the contract
Payment of the purchase price is due upon conclusion of the purchase contract. The customer can choose between various payment options. Once the organiser has received full payment, the customer will receive the tickets at the email address provided. The customer will not receive any further tickets by post or fax. They are responsible for keeping and bringing the tickets to the event. If the customer is not entitled to the corresponding ticket type, the organiser is entitled to revoke the ticket at any time and refund the purchase price to the customer, if applicable. Admission may be refused accordingly.
§3 Rights and duties
The organiser provides information and lectures for its customers and provides a platform for informative exchange. To ensure and achieve the purpose of the contract, the organiser may also use technical means such as video and chat systems.
The organiser has the right to change the schedule, content and locations of the respective events at short notice. The organiser will provide equivalent replacements wherever possible. The organiser reserves the right to hold the event online if there is a legitimate interest in doing so. In the case of an online event, the organiser shall ensure, as far as possible, that both the content of the event and the opportunity for customers to network with each other correspond as closely as possible to the standard of a face-to-face event. To this end, the organiser shall use suitable technical means to fulfil the information and networking purpose of the respective event. This does not give the customer any rights. to withdraw and/or cancel their tickets. The purchaser assures that the person for whom they are purchasing the ticket actually meets the requirements for the purchased ticket. In the event that the personal requirements do not match the type of ticket, no right to participate in the event is acquired, which is why admission may be refused. The purchaser is entitled to change the names on which the tickets purchased by him are issued up to 3 days before the event, provided that the users meet the respective conditions set out in this paragraph. After this period has expired, it is no longer possible to change the names. The parties are aware that the event is a networking event, which also thrives on the names of the participants. The purpose of the event is to get to know other people and to spread one’s own name/face. Accordingly, the organiser is entitled to publish and/or pass on to third parties the data provided by the participant to the extent permitted by the contract.
The organiser is entitled to require the customer to comply with the official orders or legal regulations applicable at the time of the event.
The organizer is entitled to register visitors entering the event area in accordance with the official regulations or legal provisions applicable at the time of the event.
The customer is obliged to use the services provided/to be provided by the organizer only for the contractually agreed purposes. The customer must ensure that their actions in connection with the event do not violate legal regulations and/or the rights of third parties. In particular, the customer is obliged to check the legal admissibility of any actions/campaigns themselves and to behave in a legally compliant manner. If third parties assert claims against the organizer in accordance with the preceding paragraphs, the organizer shall inform the customer thereof without delay. The customer undertakes to indemnify the organizer from any liability towards third parties, to support the organizer in its legal defense, and to bear the costs of reasonable legal defense, provided that the organizer is not guilty of contributory negligence. In this case, the indemnification shall be reduced by the amount of contributory negligence.
If a customer registers on behalf of another person, it must be ensured that the participating person is aware of and accepts these terms and conditions. By completing and submitting the registration form, the customer declares and guarantees that the participating person has been made aware of these terms and conditions and has accepted them.
The organizer is entitled to only allow a customer to attend events organized by FDC Events if the customer complies with the official orders or legal regulations applicable at the time of the event.
Customers who are excluded from attending the event for the reasons stated above remain obliged to pay the ticket price and are therefore not entitled to a refund of the ticket price paid. Further claims are excluded.
§4 Cancellation, postponement, cancellation by the organizer
If the organizer is forced to temporarily or permanently vacate one or more areas of the event or to postpone or shorten the event due to force majeure or other reasons beyond its control, the customer shall not be entitled to any rights of withdrawal, termination, or reduction, nor to any claims, in particular claims for damages against the organizer. The same applies if the customer is unable to attend the conference due to force majeure or other reasons beyond the organizer’s control. If the conference is postponed, the organizer shall provide the customer with tickets for the event at a later date.
If the organizer cancels the event because it cannot be held due to force majeure or other circumstances for which the organizer is not responsible, or because it has become unreasonable for the organizer to hold the event, the organizer shall not be liable for any damage or disadvantage incurred by the customer as a result of the cancellation of the event.
§5 Photos and records
Customers expressly agree that photos and recordings of them may be taken before and during the entire event and may be published, distributed, and passed on by the organizer on the Internet, in print media, and other media.
§6 Liability
The organizer shall be liable without limitation for damage caused intentionally or through gross negligence, in the event of fraudulent concealment of defects, in the event of the assumption of a quality guarantee, for claims based on the Product Liability Act, and for injury to life, limb, or health. The organizer shall only be liable for other damages if a duty is breached whose fulfillment is essential for the proper execution of the contract and on whose compliance the customer can regularly rely (cardinal obligations) or if it is a risk that can be controlled solely by the organizer. The above limitations of liability also apply to the organizer’s vicarious agents.
§7 Final provisions
German law shall apply exclusively to these General Terms and Conditions and to the respective purchase contract concluded if the customer is not a consumer. If the parties are registered traders, the city of the organizer’s registered office shall be agreed as the place of jurisdiction for all disputes arising from or in connection with this contract. Should one or more clauses in these terms and conditions be wholly or partially invalid, this shall not affect the validity of the remaining provisions.
